Uniform Commercial Code Information Overview

A UCC is a security agreement that is recorded to protect the lender’s or secured party’s investment. In a security agreement, a loan of money is secured by collateral, thereby giving the lender rights in the property.

Effective July 1, 2001, several changes became effective regarding UCC filings. Only fixture filings are accepted for filing in the Register of Deeds. A UCC fixture filing relates to items that become a part of real estate. All non-fixture filings must be filed with the secretary of state.

UCC Filings Changes

Please note the following changes affecting UCC filings as of July 1, 2001:

  • Only fixture filings are accepted for filing in the Register of Deeds. Fixture filings are indexed along with real property records.
  • A new national UCC form should be used for filings. UCC forms are available for download via the secretary of state.
  • One to two pages, the fees are $38
  • Three to ten pages, the fees are $45
  • If more than ten pages, the fees are an additional cost of $2 per page in excess of ten.
